McGreevy and Comisar, Brokered by Domain Realty

By Jesse McGreevy and Marc Comisar, McGreevy and Comisar, Domain Realty Group. Updated September 2026.

Buying at The Island at West Bay Club means buying into a tower that is still under construction, and that changes what a buyer needs to know. Our The Island at West Bay Club neighborhood guide holds the full record of the building, and this page is the buyer's side of it: what is for sale today, what Florida law gives you before and at contract, what the paperwork will say, and how we represent you. The tower sits inside West Bay Club, the gated golf-and-beach community in Estero, Florida, ZIP 33928.

McGreevy and Comisar lead Domain Realty Group, the #1 real estate team in Southwest Florida since 2012, and we are Top 1% Real Estate Agents Nationally Since 2008. We open with what the record shows: eight active Southwest Florida MLS listings from $2,699,000 to $10,099,000, zero closings in five years, and a developer delivery target of mid-2027. A buyer here is buying from plans, a model and a contract, against a date the developer has already moved once, and the protections in Florida's condominium act matter more than any price comparison.

This page is one of three. If you own a contract or a residence elsewhere and want to know its value, read our The Island at West Bay Club home valuation guide, and if you are selling a contract or planning a resale, read our The Island at West Bay Club seller's guide. For the rest of the community, see our guide to buying a home in West Bay Club.

A word on the name. This page covers the tower being built inside West Bay Club in Lee County, whose condominium association does not yet exist on the state's corporate register. It is not Island Towers on Estero Boulevard in Fort Myers Beach, not The Island at Wyndham Lakes Association and not one of the other Estero neighborhoods that share words with West Bay Club names.

Why McGreevy and Comisar Are the Best Realtor for The Island at West Bay Club

McGreevy and Comisar are the best realtor for The Island at West Bay Club because a pre-construction purchase rewards a buyer's agent who reads before advising. We read the Village ordinance, the statutes, the flood map and every active listing, and we tell you where the public record stops and the contract begins.

If you're searching for the best realtor for The Island at West Bay Club in West Bay Club, Estero, whether you're ready to sell your The Island at West Bay Club home or buy your next one, McGreevy and Comisar is the team that delivers. We lead Domain Realty Group, the #1 real estate team in Southwest Florida since 2012, Top 1% Nationally since 2008, with over $2.5 billion sold as a team and $900 million in personal sales between Jesse and Marc. Buyers comparing the best real estate agents in Estero should ask each one what they can show from the record on a building that has not closed a single unit, and we answer that in the open below.

Recent The Island at West Bay Club track record (last 12 months): In the last 12 months The Island at West Bay Club has had 0 resales in the Southwest Florida MLS (Matrix, pulled September 29, 2026), and none in the 60 months before that. We publish no count of Island purchases we represented, because none exists.

Key Takeaways

These are the points a buyer at The Island at West Bay Club should carry into any tour of the sales gallery, each one sourced later on this page from the Southwest Florida MLS, the Village of Estero, Florida statutes or the developer's own published materials.

  • No residence at The Island at West Bay Club has closed in the MLS in any window through September 29, 2026, so every price you see is an ask.
  • Eight residences were active on September 29, 2026, from $2,699,000 to $10,099,000, with a median ask of $4,073,500.
  • The developer targets mid-2027 delivery, later than the end of 2026 it gave in June 2024, and a contract's own dates control.
  • Florida Statutes section 718.202 escrows your deposit, and section 718.503 gives you 15 days to cancel after you receive all the required documents.
  • No declaration is recorded, no association exists and no fee is published, so ask for the proposed declaration, budget and rules before you sign.
  • Size figures disagree across sources, and the same price is $1,142.15 per square foot on 3,447 square feet and $1,033.06 on 3,811.
  • At our test point FEMA shows Zone AE with a base flood elevation of 11 feet, so flood insurance belongs in your budget conversation.
  • The developer's sales team represents the developer, so your own agent and an attorney should read the contract first.
  • Club membership is applied for, not assumed, and golf and social costs are separate from the tower's assessment.

What Does It Take to Buy a Home at The Island at West Bay Club?

Buying at The Island at West Bay Club takes a written buyer agreement, a clear budget including costs nobody has published yet, a contract reviewed by an attorney and a plan for the months between signing and delivery. The steps below are the same ones we use for every pre-construction buyer, adapted to this tower.

What You Are Actually Buying

You buy from plans, a model kitchen and a contract, into an 86-residence tower whose association does not yet exist. The developer describes every home as a corner residence, four per floor, with 10-foot ceilings, floor-to-ceiling glass and wide wraparound terraces, plus two half-floor penthouses. Until the certificate of occupancy, what you hold is a right under a contract.

How We Represent a Buyer, and Who Actually Does It

Jesse McGreevy and Marc Comisar represent you themselves. The developer's sales team represents the developer, and Florida Statutes section 475.278 requires a brokerage to disclose its relationship. We tour with you, read the contract with you and bring the asks, the nearby closings and the paperwork to every decision.

Step One: Set the Budget With the Full Monthly Cost

Start with what is known: the price, the deposit schedule, doc stamps if your contract assigns them to you, financing costs and insurance. Then list what is unpublished: the tower's assessment, any developer guarantee, and West Bay Club membership costs. A budget with blanks is honest, and we fill each blank as the documents arrive.

Step Two: Sign the Written Buyer Agreement

Since the NAR settlement took effect on August 17, 2024, a buyer's agent must have a written agreement with you before touring a home. It states the compensation in a specific, conspicuous amount or rate and says that compensation is negotiable. We walk through it before the first visit to the sales gallery.

Step Three: Choose the Plan, Floor and View

The eight MLS asks cover 3-plus-den and 4-bedroom plans from 3,324 to 3,680 square feet and one 6,270 square foot listing. Floor level, view orientation and size drive price, according to the developer, and we help you rank them.

Step Four: Make and Negotiate the Offer

An offer at a pre-construction tower is a contract with a deposit schedule, an incentive schedule and delivery terms. We negotiate each of them, not only the price.

Step Five: Review the Documents, Inspect and Insure

Section 718.503 gives you a 15-day window after you receive the full package. We build a checklist, an attorney reviews the contract, and we ask an insurance agent for quotes as plans allow.

Step Six: Close

Closing follows the certificate of occupancy for the building, and until then a closing date in any material is a forecast. We stay with you through final walk-through, punch list and closing.

What Is the Market Like for Buyers at The Island at West Bay Club Right Now?

The market for buyers at The Island at West Bay Club is a list of eight asks and no sales. The Southwest Florida MLS shows zero closings in every window through September 29, 2026, so a buyer has no sold price to lean on, and the asks run from $2,699,000 to $10,099,000 with a median of $4,073,500.

Data updated: September 2026 (Southwest Florida MLS Matrix, pulled September 29, 2026; Lee County Property Appraiser recorded sales through July 29, 2026)

MLS figures use MLS living area and list price. Medians use the mean of the middle pair when n is even, and every n is named. An asking price is not a sale price, and no figure here should be read as one. County recorded sales are never mixed with MLS square-foot figures.

The Four Windows

The rule we apply to every neighborhood is to lead with the first window that holds ten or more closings. Here no window holds even one.

What the Windows Say to a Buyer

They say that no buyer has yet tested a price with a closed sale, that months of supply cannot be computed because supply is measured against a closing pace and the pace here is zero, and that negotiating leverage has to come from documents and terms. Nobody can tell you the sold-to-list ratio, so anyone who does is guessing.

Where Buyers Have the Most and Least Leverage

A buyer has leverage where the record is clear: the contract's terms, the deposit structure, the delivery clause and the incentive schedule. A buyer has less where the record is silent: the price, because no sale exists, and the fees, because none are published. We focus negotiation on the first group.

Eight of the Community's 27 Active Listings

On September 29, 2026 West Bay Club had 27 active MLS listings across seven sub-names. The Island's 8 are 30 percent of them, the same count as Turtle Point at 8 and more than Jasmine Bay at 7. Jasmine Bay's seven sit against 18 closings in 12 months, and The Island's eight sit against none.

The County Record

Our neighborhood guide carries the parcel facts, and in short: The Lee County Property Appraiser's 2026 roll carries The Island as a single parcel described in a recorded instrument from 2022 as a tract of land at the tower's address, with no year built and no residential use, and no qualified sale on it. The roll will change when the declaration records and the building receives its certificate of occupancy.

What Is for Sale at The Island at West Bay Club Today?

Eight residences are for sale at The Island at West Bay Club in the Southwest Florida MLS, asking $2,699,000 to $10,099,000, and all are in a tower that cannot close until it has a certificate of occupancy. Four are 3-plus-den homes, three are 4-bedroom homes and one is a 6,270 square foot 4-plus-den residence.

How to Read the List

The eight asks total $36,734,000 and average $4,591,750, with a median of $4,073,500 (n = 8, even, the mean of $3,937,000 and $4,210,000). The median ask per square foot is $1,194.04 (n = 8, the mean of $1,142.15 and $1,245.93). Without the 6,270 square foot listing, the seven remaining asks have a median of $3,937,000 and $1,142.15 per square foot. These are small samples and none is a sale.

Which Listings Fit Which Questions

The two lowest asks, $2,699,000 and $2,826,000, are about $770 to $780 per square foot, while the other six run from $1,061.79 to $1,610.69. The developer's 2026 FAQ speaks of prices from about $2.7 million, and the lowest ask matches. Ask the listing agent which floor and view each one has, because the MLS does not say. Three identical 3,447 square foot asks differ by $694,000, or 19 percent, and floor and view are the developer's stated drivers.

Why Every Listing Shows 333 Days

All eight listings display 333 days on market on September 29, 2026, which by our arithmetic puts their entry into the MLS at about October 31, 2025. Identical figures suggest they were entered together. Days on market here counts time on the MLS and not time a buyer could close, because a unit without a certificate of occupancy cannot close, so we read it as a timestamp and not as a sign that buyers have rejected the prices.

What the MLS Does Not Show

The MLS does not show the floor, the view, the incentive schedule, the contract terms or the developer's unlisted inventory. We ask for them. A listing is an invitation, and a contract is the deal.

What Does a Residence Cost by Plan and Size at The Island at West Bay Club?

A residence at The Island at West Bay Club costs $2,699,000 to $4,949,000 for the seven standard plans of 3,324 to 3,680 square feet by MLS measure, and $10,099,000 for the one 6,270 square foot listing. Size figures differ across sources, so the price per square foot moves with the definition you use.

Which Measurement Is Which

The MLS figures match the developer's 2025 and 2026 FAQ ranges, and the residences page lists larger numbers. The developer does not say whether the larger figures include terraces, and we do not guess. A 3,447 square foot listing at $3,937,000 is $1,142.15 per square foot, and the same price over a 3,811 square foot plan is $1,033.06. Ask for the definition and the plan set in writing.

Finishes, Parking and Charging

Kolter Urban's release describes European cabinetry, quartz countertops, Sub-Zero and Wolf appliances, full-size laundry, walk-in closets and spa-style bathrooms, with porcelain tile floors. Parking is underground and gated with two spaces per residence, and the developer's amenity page says each residence includes infrastructure to support installing a commercial EV charger at its assigned spaces, which is narrower than the pre-installed chargers some marketing copy has described.

What the Record Cannot Show Yet

The structural design, the foundation report the ordinance requires, the insurance program and the finished-unit specifications are not in the public record we read. A certificate of occupancy will be the first public document that says the building is finished.

How Do Prices at The Island at West Bay Club Compare With Nearby Communities?

Prices at The Island at West Bay Club sit above every West Bay Club neighborhood by ask: the lowest ask of $2,699,000 is about 1.87 times the highest Jasmine Bay closing of the last 12 months, $1,440,000, and level with Westlake Court's $2,700,000 median. An ask is not a sale, so the comparison shows scale only.

Which Neighbor to Tour on the Same Morning

A buyer near $2.7 million should tour Westlake Court, where six homes closed in 24 months at a $2,700,000 median and $891.83 per square foot, beside the tower's lowest ask. A buyer who wants a built tower should tour Jasmine Bay, where 18 homes closed in 12 months from $525,000 to $1,440,000. The Island's median ask per square foot of $1,194.04 sits about a third above Westlake Court's closed figure.

What the Comparison Means for Your Offer

It means that an offer at The Island should be argued from the developer's schedule, the plan, the terms and the delivery date, and not from neighborhood medians. Jasmine Bay's closings show that the same plan can sell for very different amounts, from $525,000 to $1,050,000 at 1,766 square feet, so condition, floor and view matter more than size alone.

The Island at West Bay Club vs Jasmine Bay: Which Should You Buy In?

Buy at The Island at West Bay Club for a new 24-story tower with corner residences from about $2.7 million by ask and delivery anticipated in mid-2027. Buy at Jasmine Bay for a 2007 tower you can close on now, with 18 closings in 12 months at a $701,250 median. The tower trades certainty for newness.

Who Should Choose The Island

A buyer who wants a new corner residence, is comfortable committing before completion and can read a prospectus, a budget and a contract with an attorney beside them should look at The Island. The tower offers a choice of floor and view while inventory remains, a new building with a fresh warranty and inspection clock, and underground parking with two spaces per residence.

Who Should Choose Jasmine Bay

A buyer who wants to close soon, see sales history and walk a finished building should look at Jasmine Bay. Its known association, known budget history and milestone date decades away reduce the unknowns, and its prices sit far below the tower's asks.

Timing and Risk

A pre-construction buyer takes schedule, completion and turnover risk in exchange for a new building. That is a trade, not a verdict, and the statutes in sections 718.202 and 718.503 reduce some of the risk. McGreevy and Comisar are Top 1% Real Estate Agents Nationally Since 2008, and we walk you through both.

What Does Florida Law Give a Buyer at The Island at West Bay Club Before Contract?

Florida law gives a buyer at The Island at West Bay Club a package of disclosures, an escrow for deposits, a 15-day cancellation window and a state filing the developer must make before closing. They come from Chapter 718, the condominium act, because the tower will be a condominium. Section 718.503 lists the documents you must receive.

Chapter 718, Not Section 720.401

The Island will be a condominium, so Chapter 718 governs, including the developer's disclosure in section 718.503. West Bay Club also has a master association, West Bay Club Community Association, Inc., and whether the tower's owners are members of it is a question for the package. Section 720.401, the homeowners' association disclosure summary that applies before a buyer signs in a mandatory HOA community, does not apply to associations under Chapter 718, so we do not treat it as the rule here. If the master's covenants bring any Chapter 720 duty, your closing agent or attorney decides, and this page is information and not legal advice.

The Documents You Must Receive

Section 718.503 requires a developer to deliver either a prospectus or the listed documents, including the proposed declaration with a surveyor's certificate, the association's documents, bylaws, management and other contracts longer than one year, the estimated operating budget, the form of sales agreement, the unit floor plan and plot plan, covenants and restrictions, evidence of the developer's interest in the land, and statements on the milestone inspection, the reserve study and the turnover inspection report. Section 718.504 describes the prospectus and its frequently asked questions and answers sheet.

The 15-Day Cancellation Window

The contract is voidable by the buyer for 15 days after the buyer signs and receives all the items the developer must deliver, so the clock does not start until the documents are complete. Keep a dated receipt for every document and count from the last one. A package missing a budget or the rules leaves the clock unsettled.

The Division Filing

Under section 718.502 a developer of a residential condominium files its documents with the Division of Condominiums, and until it does, a contract is voidable by the purchaser before closing. The developer may not close until the Division notifies it that the filing is proper. The Division's public extract that we read does not list The Island, which is what we expect before a declaration is recorded, and we ask the developer for the filing.

The Property Tax Disclosure and the Flood Disclosure

Section 689.261 requires a property tax disclosure summary because taxes can change after a sale. On flood, ask for the elevation certificate and the developer's flood statement, and ask your insurance agent what a policy for Zone AE would cost once plans allow.

The Milestone Inspection and Reserve Statements

Section 718.503 requires statements on the milestone inspection, the reserve study and the turnover inspection report. Section 553.899 requires a milestone inspection of a building of three habitable stories or more by December 31 of the year it reaches 30 years from its certificate of occupancy, and a tower completed in 2027 would face 2057, or 2052 if the local agency applies the 25-year test. That is our arithmetic, not a published schedule.

How Do Deposits, Escrow and the Purchase Contract Work at The Island at West Bay Club?

A buyer at The Island at West Bay Club pays deposits that Florida Statutes section 718.202 requires to be held in escrow, up to 10 percent of the price while construction is not substantially complete, and signs a contract that controls delivery, delay and termination. The contract, which we have not seen, decides what happens if the schedule moves.

Deposits Above 10 Percent

Amounts above 10 percent are held in a separate escrow, and if the contract provides for it, the developer may use those excess funds for actual construction costs once construction has begun, but not for salaries, commissions, marketing or loan costs. A contract that permits this must carry a bold legend saying so, and we look for that legend first.

Reservation Deposits

Section 718.202 also covers reservation agreements. A reservation deposit goes into escrow, is refundable on written request, and may not be released to the developer except as a down payment when a contract is signed. A reservation is not a contract, and the difference is worth a call to your attorney before you pay anything.

Delivery Dates, Extensions and Termination

The developer has moved its stated delivery once, from the end of 2026 in June 2024 to mid-2027 in its February 2026 FAQ. Read the contract for the outside date, what extensions it allows, when a buyer may terminate, whether a deposit is returned with interest and what a buyer's remedies are. A marketing date is not a promise, and the contract's date is.

Incentives and Assignments

Kolter Urban's 2024 release mentioned special pre-construction incentives available for a limited time. Any incentive, price protection or credit should be in the contract's text, and any right to assign or resell a contract before closing is also a contract term. We read both before advising you.

Why You Want an Attorney

We are not attorneys. A Florida real estate attorney should read the contract, the escrow terms and the assignment and default clauses before you sign. We provide the market context, the comparisons and the questions to ask.

How Do the Association, Estoppel and Club Membership Work at The Island at West Bay Club?

The Island at West Bay Club has no association yet, so a buyer signs without a budget, and later owners will rely on an estoppel certificate under section 718.116 and the club's membership rules. West Bay Club membership is applied for and is separate from the tower, and each layer has its own paperwork.

No Association Yet

Florida's corporate register shows no entity named for The Island at West Bay Club as of September 30, 2026, and the state's public condominium extract lists no project by this name. A condominium association is created with the declaration, so it appears when the developer records it, which the developer's own material points to mid-2027.

The Developer's Guarantee or Excusal

Section 718.116(9) lets a developer offering units be excused from paying assessments on unsold units for a stated period, provided the declaration authorizes it, and requires the developer to cover common expenses that exceed the regular assessments collected. The stated period must end no later than the first day of the fourth calendar month after the month of the first closing. A developer may alternatively guarantee that assessments will not exceed a stated dollar amount. Whether Kolter's documents use either mechanism is unknown to us.

Why the First Budget Is a Poor Guide to the Third

A developer-controlled budget covers a new building with warranties in force and a small number of owners. Later budgets can move as warranties expire, reserves are funded, insurance renews and owners take over the board. Compare the first year's figure with the reserve schedule and the insurance assumptions, and not with the headline.

Turnover

Section 718.301 lets owners other than the developer elect at least one-third of the board once they own 15 percent of the units, which for 86 units is 13 units by our arithmetic. Owners elect a majority on the first of several events, including three years after 50 percent of the units are conveyed (43 units) and three months after 90 percent are conveyed (78 units), or seven years after the recording of the surveyor's certificate or the first unit transfer.

The Estoppel Certificate

At a resale the association issues an estoppel certificate stating what is owed. Section 718.116 caps the fee at $299 for a current account, with $119 more for expedited delivery and $179 more if the account is delinquent. The certificate is valid for 30 days, or 35 if sent electronically, and the fee is refunded within 30 days of a written request if the sale does not close.

The Club Membership

The developer's FAQ says residents may enjoy club amenities once approved for membership and calls the ability to apply for expedited membership a rare opportunity. The club's own FAQ says its golf cap is 300 members for 18 holes, that Social membership is for residents only, and that Premier memberships transfer only with the sale of a home. Our West Bay Club hub gives a slightly different cap figure, so confirm the number with the club.

What the Club Charges

Golf initiation and dues, Social and Premier fees and food-and-beverage minimums are club charges and not tower assessments. Our West Bay Club research reports a 2026 Premier schedule of about $130,000 in initiation and roughly $16,900 in annual dues, and a Social fee of about $3,000, and warns that those figures have moved. Confirm them in writing before you rely on them.

What We Do Not Know

We do not know the tower's assessment, whether membership is mandatory under the contract, whether the tower's owners belong to the master association, or what approval the association will require for a sale or a lease. Each is in the documents, and we ask for them.

What Should You Inspect Before Buying at The Island at West Bay Club?

Before buying at The Island at West Bay Club you inspect documents now and the building later. The plan set, the declaration, the budget and the contract are the inspection before a certificate of occupancy, and a final walk-through, punch list and an engineer's review are the inspection after it.

Before Completion: The Paper

Read the proposed declaration, the bylaws, the budget and reserve schedule, the floor plan with your residence marked, the size definition, the incentive addenda and the delivery clause. Ask for the building permit and site plan numbers and look them up on the Village of Estero's permits page and Lee County Community Development yourself.

At Completion: Walk-Through and Punch List

When the building is finished, walk the residence with us against the plan set. Check finishes against the release's description, terraces and sliders, appliance packages, parking spaces and storage. Write a punch list and keep dated photographs.

Turnover Reports

At turnover the developer must deliver inspection reports under the seal of an architect, engineer or certified reserve specialist covering the roof, structure, fireproofing, plumbing, electrical, waterproofing, windows and exterior doors, and separately elevators, HVAC, pool equipment, seawalls, pavement, drainage and irrigation, plus the association's most recent structural integrity reserve study. An independent engineer's reading is worth the fee.

What the Ordinance Requires of the Builder

Ordinance 2021-12 requires the project to follow the Garcia Stromberg pattern book dated October 1, 2021, non-reflective glass, at least 60 percent open space, 90 percent of required parking under the principal building, and an independent geotechnical engineer's foundation recommendation from multiple borings, signed and sealed, before a building permit. We have not read the development order, and we do not state what it contains.

Defect Claims

Section 718.301(7) says a defect claim against a developer must be examined and certified by an appropriately licensed Florida professional. Owners inherit that decision, which is one reason turnover paperwork deserves an engineer's reading.

How Do You Insure a Residence at The Island at West Bay Club?

You insure a residence at The Island at West Bay Club with an HO-6 policy for contents, interior and loss assessment, while the association's master policy covers the structure. At a point near the club's West Bay Boulevard address FEMA shows Zone AE with a base flood elevation of 11 feet, so flood coverage belongs in the plan.

The Map and the Panel

FEMA's National Flood Hazard Layer returns Zone AE with the subtype coastal floodplain at our test point, a special flood hazard area flag of true and a static base flood elevation of 11 feet, on panel 12071C0587G effective November 17, 2022. It is a map reading for one point, not a survey of the tower's footprint, and the developer's elevation certificate will show the finished floor and the parking level against the base flood elevation.

What Zone AE Means for a Loan

A federally backed mortgage requires flood insurance in a special flood hazard area, which includes zones starting with A. For a high-rise, the association's master flood policy and any lender requirement matter more than the unit's floor, and the answer depends on the elevation certificate and the insurer. The Village of Estero says anywhere it rains it can flood.

Ian and Milton

Hurricane Ian made landfall in September 2022 as a Category 4 storm near Cayo Costa, and its worst surge fell on the coast and islands. Hurricane Milton in October 2024 made landfall near Siesta Key as a Category 3, north of Lee County. The tower was not standing for either storm, so West Bay Club's older neighborhoods have a storm history and this one has none.

The Master Policy, the HO-6 and Loss Assessment

Section 718.111 governs association insurance and section 627.714 governs unit owner loss assessment coverage. Ask for the master policy summary, the wind and flood deductibles and the developer's stated code edition, and ask an insurance agent for a quote when plans allow. We publish no premium, because none exists for a building that is not finished.

Wind Mitigation

Florida's Uniform Mitigation Verification Inspection Form, OIR-B1-1802, documents wind-resistive features for insurers. For a new building, ask the developer which features it will document and whether the association or the owner holds the form.

What Will You Pay Each Month to Own a Residence at The Island at West Bay Club?

A monthly budget at The Island at West Bay Club has known lines and blanks: mortgage, property tax and insurance can be estimated, while the tower assessment and club dues cannot yet be quoted. We publish no fee figure, because none is published, and we help you fill each blank when the documents arrive.

No CDD

West Bay Club is governed by property owners associations and carries no Community Development District bond assessment, per our community research. Before any closing we confirm the absence of a CDD line on the parcel's tax record, because a buyer should see it on the bill.

Property Tax After Closing

Lee County bills property tax on the assessed value as of January 1, so a first bill after closing may reflect a partial or land-only assessment and later bills can step up. Homestead under section 196.031 depends on making the home your permanent residence as of January 1, and a second home does not qualify.

What Are Buyer Closing Costs at The Island at West Bay Club?

Buyer closing costs at The Island at West Bay Club are contract-driven: a developer's first sale follows the developer's form, which we have not seen, and a resale follows the ordinary Florida contract. Lee County custom puts doc stamps and the owner's title policy on the seller in a resale, and puts recording and loan-related taxes on the buyer.

Data updated: September 2026 (Florida Statutes and Department of Revenue rules)

Deed Doc Stamps and the Owner's Policy

The deed documentary stamp tax is $0.70 per $100 under section 201.02, which is $18,893.00 at $2,699,000, $28,514.50 at $4,073,500 and $70,693.00 at $10,099,000. The owner's title premium would be about $9,322.50 at $2,699,000 and about $12,758.75 at $4,073,500. In Lee County the seller customarily pays both on a resale, and the contract controls who pays on a developer's first sale.

What a Financing Buyer Adds

A new mortgage carries documentary stamp tax of $0.35 per $100 on the note, capped at $2,450, and nonrecurring intangible tax of $0.002 per $1 on the mortgage. On a hypothetical $2,000,000 loan that is $2,450 and $4,000, before the lender's title policy, which the buyer pays. The deed is customarily recorded by the buyer, at $10.00 for the first page and $8.50 for each additional page under section 28.24.

Closing Charges and Prorations

Settlement and search fees commonly run $500 to $1,500 and $150 to $500, and they vary by title company. Property tax is prorated at a closing on a calendar-year basis, paid in arrears.

Developer Forms Differ

A developer's first sale may assign title charges, capital contributions and transfer fees differently from a resale. We read the form's closing-cost clause line by line before you sign.

How Does Buyer Representation Work After the NAR Settlement at The Island at West Bay Club?

Buyer representation at The Island at West Bay Club works under the post-settlement rules: a written agreement before any tour, compensation that is negotiable and stated in a specific amount or rate, and no MLS advertising of buyer-broker compensation. The developer's sales team represents the developer, so you need your own agent.

The Written Agreement

Effective August 17, 2024, a buyer's agent must have a written agreement with you before touring a home, in person or live virtual. It must state the compensation in a specific, conspicuous amount or rate and state that broker compensation is fully negotiable and not set by law.

Who Pays Your Agent

Compensation is negotiated. A developer may agree to pay a buyer's agent or may not, and a seller may offer it off-MLS. We explain each arrangement in writing before you sign, so nothing about it is a surprise at closing.

Registering on the First Visit

The developer's site asks visitors whether they are working with a real estate professional. Tell the gallery on your first visit, or better, bring us to your first visit. Section 475.278 requires the brokerage relationship to be disclosed.

What We Do for You

We compare the asks, bring the nearby closings, read the contract and disclosure package with you, ask the developer for the filing and the budget, and negotiate terms as well as price. We describe the property and never who should buy.

Can You Finance a Residence at The Island at West Bay Club?

You can finance a residence at The Island at West Bay Club, but most pre-construction buyers pay deposits during construction and arrange the loan near completion, and lenders underwrite the condominium project as well as the buyer. The lender's project approval depends on the recorded declaration and the association's budget.

Deposits First, Loan Later

Deposits are paid under the contract's schedule and held in escrow under section 718.202. Closing financing is arranged as the certificate of occupancy approaches, and rates are whatever they are then, so ask whether your contract allows a rate-related extension or a financing contingency.

What a Lender Will Ask

A lender will ask for the association's questionnaire, budget, insurance certificate and financial statements, and will review owner-occupancy and delinquency levels. In a tower that has just turned over, expect a slower package while the association is new. The Consumer Financial Protection Bureau's loan estimate guide explains the paperwork you will receive.

Rates and Affordability

Freddie Mac publishes its Primary Mortgage Market Survey weekly, and it is the neutral source for average rates. We do not quote a rate on this page, because a pre-construction rate is set near closing. Ask your lender what a rate lock costs and how long it lasts.

Cash Buyers

A cash buyer skips lender project approval but still needs the disclosure package, the escrow terms and the flood and insurance review. The 15-day cancellation window and the deposit rules apply the same way.

How Do We Find You the Right Residence at The Island at West Bay Club?

We find you the right residence at The Island at West Bay Club by matching your budget and priorities to the plans, floors and views still available, touring the developer's sales gallery with you, and comparing each ask against the others and against nearby closings. We also watch the MLS for new listings and changes.

The developer's sales gallery is open by private appointment on South Tamiami Trail. We schedule it with you, attend, and ask the questions in this guide, including which floor, view and size definition apply to each residence.

Ranking What Matters

We ask you to rank floor level, view orientation, plan size, terrace size, delivery date and price. The developer says floor, view and size drive price, so your ranking tells us which asks to show you first.

Watching the List

The eight asks entered the MLS together about October 31, 2025. We watch for changes in price, new entries and withdrawals, and we tell you what a change might mean, without pretending to know more than the record shows.

Comparing With Jasmine Bay and Westlake Court

If the tower's asks are more than you want to carry, we show you Jasmine Bay's finished towers and Westlake Court's villas side by side with your list. A buyer should decide on the facts, not on the developer's presentation.

How Do We Negotiate for You at The Island at West Bay Club?

We negotiate for you at The Island at West Bay Club on terms as much as price: the deposit schedule, the incentive and credit terms, the delivery and outside dates, termination rights, upgrades and the assignment clause. One of our clients wrote of a build-phase purchase that Marc negotiated a much better deal from the builder.

Price

With no closings, price is argued from the developer's schedule, the asks and the plan. The two lowest asks sit near $770 per square foot and the other six run from $1,061.79 to $1,610.69, so the first question is which one you are actually looking at.

Terms

Terms we ask for include a clear outside date, a right to terminate after a stated delay, deposit interest, a defined size and a written incentive schedule. A contract that leaves them open leaves the risk with you.

Upgrades and Credits

Where the developer offers credits or upgrades, we want them written into the contract with values, not described in a brochure. A promise in a sales gallery is not a term unless it is in the agreement.

Walking Away

Sometimes the right answer is another building. We tell buyers when Jasmine Bay, Westlake Court or a different community serves them better.

Which Tower Rules Decide Whether a Residence at The Island at West Bay Club Works for You?

The rules that decide whether a residence works for you at The Island at West Bay Club are in a declaration that has not been recorded, so none is public: leasing, pets, age, approvals and use. Get the proposed declaration's language in writing before any deposit becomes non-refundable.

Renting Out a Residence

Kolter Urban's materials sell the residences as lock-and-leave homes for full-time and seasonal use, and they do not describe a rental program. We found no published rental rule. Ask whether leases are allowed, the shortest term, how many leases a year, whether tenants need approval and pay a fee, and whether tenants may use the amenities. A buyer who needs stays shorter than a month should treat them as not allowed until the recorded declaration says otherwise.

Pets

The developer's amenity plan includes a private dog park just outside the building, an indoor dog-washing room with a grooming table and dryers, and a pet-friendly description of the building. Limits on number, size and breed will be in the declaration or rules. Assistance animals are handled under federal fair housing rules, per the U.S. Department of Housing and Urban Development.

Age

The Island at West Bay Club is not marketed as a 55-plus community, and no age-restricted declaration exists because none is recorded. We describe the property and the legal facts, not the people who live in it, and we re-read the declaration when it records.

Approval of Sales and Leases

Whether the association will require approval of a sale, a lease or a transfer, and what fees it may charge, is set by the declaration. We ask for the process before an offer.

What Will Daily Life Be Like at The Island at West Bay Club?

Daily life at The Island at West Bay Club will run through West Bay Club's manned gatehouse and the tower's access-controlled lobby, garage and elevators, with a rooftop pool, club room and fitness center in the building and the club's golf, beach and racquet facilities a few minutes away. Amenities are plans until the building is finished.

The Tower's Own Amenities

The developer's amenity page lists a rooftop Relaxation Pool with sun shelf and whirlpool spa, a rooftop open-air kitchen with grill, bar and fire pits, an arrival-level resort pool with a lap lane, family pool, spa and cabanas, a summer kitchen, a Club Room with catering kitchen and club bar, a Splash Lounge, a business center, a fitness center, a sports lounge with a golf simulator, and two one-bedroom guest suites. Those are plans, not built rooms.

Services and Security

The amenity page describes a porte-cochere arrival, on-site staff for guests, deliveries and home services, a mail room with package storage and access-controlled entry. The developer's FAQ says 24/7 staffed lobby services, while the amenity page says on-site staff are available during business hours, a difference to resolve in writing since staffing is a budget line.

West Bay Club Beyond the Tower

The club describes 868 acres with 500 conserved, eight Har-Tru tennis courts, pickleball, bocce, dog parks, a fitness center, the Bay House, River Park on the Estero River and a private Beach Club on Little Hickory Island that was rebuilt and reopened in March 2024. The Dye golf course is a separate equity membership.

Schools and Healthcare

The Island at West Bay Club addresses sit in the School District of Lee County's elementary Proximity Zone Q, middle Zone GG and High School South Zone, Sub-zone 3 on the district's 2026 to 2027 map, read at our sample points on October 17, 2026. Zone Q elementary schools are Bonita Springs, Pinewoods, San Carlos Park, Spring Creek and Three Oaks; Zone GG middle schools are Bonita Springs Middle and Three Oaks Middle; South 3 high schools are Bonita Springs High, Estero High and South Fort Myers High. Families rank the schools in their zone and the district places students by preference, proximity and lottery, so no school is assigned by address; confirm yours with the district's school locator. Lee Health Coconut Point on Via Coconut Point has an emergency department.

Construction Nearby

Williams Road serves the tower and the Village's new Entertainment District, and January 2026 reporting lists Woodfield Estero, Lumio Estero and other projects among the largest under way in Estero. Construction traffic for the tower and other projects uses the same corridor until mid-2027.

Is The Island at West Bay Club the Right Place for You to Buy?

The Island at West Bay Club is the right place to buy if you want a new corner residence in an established gated community and can accept schedule, turnover and flood-zone facts. Its strengths are a new 86-residence building with a Village-approved design, and its weaknesses are no closed sales, no published fees and a moved delivery date.

The Pros

  • A new building. Every system, finish and amenity is new, and the warranty and inspection clocks start fresh.
  • Small scale. Eighty-six residences, four per floor, per the developer.
  • Corner plans. Every residence is a corner home with wide terraces, per the developer.
  • An established community. The gate, golf, racquet facilities and Beach Club already exist.
  • A public approval record. Ordinance 2021-12 sets height, units, open space and design.
  • Deposit protection and a cancellation right. Sections 718.202 and 718.503.
  • A choice of floor and view while inventory remains.

The Cons

  • No closed sale. No price has been tested by a completed transaction.
  • No published assessment. The budget arrives with the disclosure package.
  • A moved schedule. Delivery slid from the end of 2026 to mid-2027 in the developer's own statements.
  • Size figures disagree across the developer's releases, its residences page and the MLS.
  • Membership is applied for. Golf and club costs are separate.
  • Zone AE at our test point, with a base flood elevation of 11 feet.
  • Construction activity in the community until delivery.
  • Turnover risk. Owners do not control the association until statutory triggers are met.

Questions to Ask Yourself

Can you carry the deposits for the schedule the contract sets? Are you comfortable with a mid-2027 target that could move again? Do you need the amenities and the club, and can you confirm their cost? If the answer to any is no, another building may serve you better.

Get Your Personalized The Island at West Bay Club Buyer Consultation

A personalized buyer consultation with McGreevy and Comisar is a working conversation and not a sales pitch. We match your budget to a plan and a floor, walk the documents and a monthly cost with its blanks, set a plan for the sales gallery and tell you honestly whether The Island or a neighbor fits better.

The consultation form sits near the top of this page. You can also call Marc Comisar direct at (239) 287-5873 or Jesse McGreevy at (239) 898-6072, or read how we represent buyers in Southwest Florida first. We have been Top 1% Real Estate Agents Nationally Since 2008.

What We Do in the First Conversation

We ask what you want from the building, your timeline and your budget, and we tell you what the record shows: the eight asks, the developer's schedule, the nearby closings and the documents to request. There is no cost and no obligation.

What to Bring

Bring any developer materials you have, a rough budget, your financing plan and your questions. If you hold a reservation, bring its terms.

Why Does a Specialist Matter for a Buyer at The Island at West Bay Club?

A specialist matters for a buyer at The Island at West Bay Club because the usual signals are missing: no closings, no fees, no declaration and conflicting size figures. A generalist who quotes neighborhood averages will quote other buildings, and a buyer's agent who has read the ordinance and the statutes can ask better questions.

Reading the Ordinance

The neighborhood guide sets out the approvals in full, and our West Bay Club community guide covers the club. We read Ordinance 2021-12 end to end, including its nine conditions and its exhibits. It is the closest thing to a public rule book for the building.

Labeling Every Number

An ask is not a sale, a county median is not an MLS median and an estimate is not a measurement. We label each and name the window beside it.

Saying What We Did Not Read

We have not read the development order, the building permit set, the foundation report, the sales contract, the prospectus or any recorded document. We say so, and we ask for them on every purchase.

Can I sell my current home and buy at the tower on the same timeline?

Usually that takes planning, because a tower's closing date follows the certificate of occupancy and not your calendar. We map your sale against the delivery clause, so you are not forced to sell early or carry two homes longer than you intend.

Should I list before or after I sign a contract?

It depends on your financing and your risk tolerance. A deposit schedule runs on the contract's dates, while a sale runs on the market's, and we show you the trade before you commit to either.

Does selling first change how a developer treats my offer?

It can, because a financing contingency or a home to sell is a term the developer weighs. We raise it early and in writing, so the contract shows what both sides agreed.

What is my current home worth?

Request the free valuation above, and Jesse will give you a written opinion built from closed sales near your address.

Will you represent me on both sides?

We represent you as your agent on the sale and on the purchase, with the brokerage relationship disclosed under section 475.278.

Frequently Asked Questions, Buyer Edition: Buying a Home at The Island at West Bay Club

These are the questions buyers ask most about The Island at West Bay Club, a pre-construction condominium tower in Estero, answered from the developer's published materials, Village of Estero Ordinance 2021-12, Florida statutes and the eight active listings. Where a record is not public, the answer says so.

What is The Island at West Bay Club?

The Island at West Bay Club is a luxury condominium tower under construction inside the gated West Bay Club community in Estero, developed by Kolter Urban. The developer describes 86 corner residences and a mid-2027 delivery target, and Ordinance 2021-12 entitles up to 88 units.

Is The Island at West Bay Club built yet?

No. It is under construction, and the developer's construction-update page is the record to watch. Nothing has closed, the Lee County Property Appraiser shows a land parcel and not residences, and the association does not yet exist as a Florida corporation.

Where is The Island at West Bay Club?

It sits inside the manned gate of West Bay Club in Estero, ZIP 33928, at the west end of Williams Road west of US-41. We use no street number, because the Census geocoder returned no address match for the tower.

Who is the developer?

Kolter Urban is the developer named on the developer's site, its groundbreaking release and its portfolio page. Ordinance 2021-12 is the Village of Estero approval that governs the site, and it is the public record of what the developer is allowed to build.

How many residences are there and how tall is the tower?

The developer publishes 86 residences and 24 stories, and Ordinance 2021-12 allows up to 88 units and 23 stories over parking. We read them as the same building counted two ways: the ordinance's 23 habitable stories plus a parking level, and 86 as the plan under the 88 ceiling.

When will it be finished?

The developer's current materials target mid-2027, later than the end-2026 date it gave in June 2024. Delivery dates in a pre-construction contract are targets with conditions, so read the completion and delay clauses with an attorney and treat the date as an estimate.

What do homes cost?

On September 29, 2026, eight residences were active in the Southwest Florida MLS, asking from $2,699,000 to $10,099,000 with a median ask of $4,073,500 (n = 8). The developer's 2026 FAQ speaks of prices from about $2.7 million, which matches the lowest ask.

Are there resale prices?

No. There are zero MLS closings in 12, 24, 36 and 60 months and no qualified county sale. We publish no median sold price, price per square foot from closings, days on market or sold-to-list figure for this tower.

How big are the residences?

The MLS lists 3,324 to 3,680 square feet for the seven standard residences and 6,270 for the one large listing. Published ranges differ by source, and the developer does not state its measurement definition, so compare plans by the same measure before comparing prices.

How does a deposit work?

Florida Statutes section 718.202 holds deposits in escrow with an independent agent, up to 10 percent while construction is not substantially complete. The statute allows a developer to use deposits above 10 percent for construction only if the contract permits it, and the contract must carry a bold legend saying so.

Can I cancel a contract after signing?

Under section 718.503 the contract is voidable by the buyer for 15 days after the buyer signs and receives all the required documents. The clock depends on receiving the complete package, so keep dated proof of what you received and when.

What documents must the developer give me?

Section 718.503 lists the prospectus or the proposed declaration and exhibits, the budget, the form of sales agreement, the floor plan and other items, and section 718.504 describes the prospectus. Ask for every exhibit, because a package missing the budget or the rules leaves the clock unsettled.

What are the association fees?

They are not public. The association has not been recorded or incorporated, so no budget, assessment schedule or reserve funding is on file, and the developer's fee statements are marketing until they appear in the contract's budget exhibit.

Do I have to join West Bay Club?

The developer describes club membership as available to residents, and the club's membership FAQ describes an application process, so treat membership as applied for and not automatic. Golf, social and beach costs are separate from the tower's assessment.

Is there a cap on golf memberships?

The club's FAQ publishes a cap of 300 members for 18 holes, and our West Bay Club hub gives a slightly different figure. Confirm the current number and your place in line with the club before you rely on golf access.

Is there a beach club?

The developer's amenities page and the club's Beach Club page describe a private Beach Club on Little Hickory Island that the club rebuilt and reopened in March 2024. Access and use rules are set by the club, so ask for the current terms in writing.

What amenities are in the tower?

The developer's plan lists a rooftop pool and open-air kitchen, an arrival-level resort pool, a Club Room, a fitness center, a sports lounge with a golf simulator and two guest suites, with underground parking at two spaces per residence. The budget will show which are common expenses.

Is it in a flood zone?

At the club's address point FEMA returned Zone AE with a base flood elevation of 11 feet on panel 12071C0587G. That is a point query and not a survey of the footprint, so the elevation certificate for the finished building is the document that decides your insurance.

How did Ian and Milton affect it?

The tower was not standing for either storm, so it has no storm history. The National Hurricane Center's reports on Ian in 2022 and Milton in 2024 describe the regional events, and any claim about this building's performance must wait for the building and its engineering documents.

What insurance does a buyer need?

Condominium owners typically carry an HO-6 policy, and section 627.714 addresses loss assessment coverage and owners' policies. The association carries the building policy, and a lender may require flood coverage, so get quotes from your agent before you commit.

Is it a 55-plus community?

Nothing in Ordinance 2021-12, the developer's site or the club's public materials describes an age restriction for the tower. An age restriction would have to appear in the recorded declaration, which does not yet exist, so confirm it in the contract documents.

Can I rent out a residence?

That is set by the declaration and rules, which are not yet recorded. Minimum lease terms, approval steps and rental caps vary by building, so ask the developer for the draft rental provisions before you sign, especially if the purchase is meant as an investment.

Are pets allowed?

Pet rules will be in the declaration, and none are public yet. The developer's plan includes a private dog park and a dog-washing room. Federal fair housing rules treat assistance animals separately from pets, as HUD explains.

Which schools serve it?

The Island at West Bay Club is in elementary Zone Q, middle Zone GG and high school South 3 on the district's 2026 to 2027 map, so Pinewoods Elementary, Three Oaks Middle and Estero High are among a family's ranked choices rather than assigned schools; confirm your address with the district's school locator. Confirm the assignment for your address with the district before you buy.

What are the closing costs?

They include title charges, doc stamp tax on the deed at $0.70 per $100 under section 201.02, recording fees, and on a financed purchase the tax on the note and the mortgage. Who pays each item is set by the contract, and a developer's form often differs from a resale form.

What property taxes should I expect?

The Lee County Property Appraiser assesses each parcel as of January 1, and a pre-construction site carries land or partial-completion value until the residence is complete. Section 689.261 requires a disclosure summary because taxes can change after a sale.

Can I claim homestead?

Section 196.031 requires making the home your permanent residence as of January 1. A second home does not qualify, and a first-year owner should check the Property Appraiser's filing deadline and rules after closing.

Can I get a mortgage on a pre-construction residence?

Many buyers pay a deposit schedule during construction and arrange financing near completion, and lenders underwrite the condominium project as well as the buyer. The CFPB's loan estimate guide explains the paperwork, and Freddie Mac publishes weekly average rates.

Should I use my own agent?

Yes, because the developer's sales team represents the developer. Section 475.278 requires brokers to disclose their relationship to you, and a buyer's agent from McGreevy and Comisar reads the contract, compares the asks and brings the nearby closings. Ask about our buyer representation terms before you visit the sales gallery.

How does the NAR settlement affect me as a buyer?

Since August 17, 2024, your agent needs a written agreement with you before touring, stating compensation in a specific amount or rate. Compensation is negotiable and not set by law, and offers of buyer-broker compensation cannot be advertised in the MLS.

How does The Island compare with Jasmine Bay?

Jasmine Bay is a 2007 two-tower condominium with 217 homes, 18 closings in 12 months and a $701,250 median. The Island is new, has no closings and asks about $4.07 million at the median. Our decision table above sets them side by side.

What could go wrong with a pre-construction purchase?

The main risks are schedule delay, a change to plans or budget, a developer that does not complete, and buyer default. The escrow rules and the cancellation period reduce some of those, and an attorney reviewing the contract before signing is the practical protection.

How do I verify permits?

The Village of Estero's permits page and Lee County Community Development are the public starting points, and Ordinance 2021-12 states the approval conditions. Ask the developer for the building permit and site plan numbers, then look them up yourself.

Who should call McGreevy and Comisar about The Island?

Anyone weighing a purchase, a contract review or a comparison with Jasmine Bay, Westlake Court or another West Bay Club neighborhood. McGreevy and Comisar are Top 1% Real Estate Agents Nationally Since 2008, and Marc can be reached at (239) 287-5873.

What happens when the owners take over the association?

Section 718.301 sets the turnover triggers, including 15 percent of units for one-third of the board, three years after 50 percent of units are conveyed and three months after 90 percent. At turnover the developer delivers inspection reports and the reserve study.
